Abu Dhabi court obligates company to pay sales manager Dhs88,000 as compensation

The Abu Dhabi Appellate Court obligated a company to pay a sales manager who worked for it Dhs88,000 as labour rights, and also obligated it to pay the fees and expenses of the lawsuit, after the sales manager filed a lawsuit demanding his dues.

The company indicated that it terminated the appellee’s services due to his poor performance in his work, as he did not succeed in attracting any client to the company.

The details of the case date back to an earlier time when the appellant filed a lawsuit in which he demanded the company he worked for to pay him Dhs18,000, as salaries and end-of-service gratuity of Dhs11,760, compensation for unfair dismissal at a rate of 3 months, equaling Dhs54,000, a warning allowance of Dhs54,000 and legal interest of 12% from the date of the claim until full payment, in addition to the fees and expenses of the case. He also requested to hand over the experience certificate.

In his lawsuit, the manager indicated that he joined the company under an indefinite employment contract as a sales manager for Dhs18,000, the basic amount of which was Dhs12,600, adding that he remained at his job until the company arbitrarily terminated his service without warning and did not pay him his dues.

The company’s lawyer affirmed that the appellant performed poorly in his work, and did not succeed in attracting any client to the company, pointing out that the company warned him and due to the coronavirus pandemic, it reduced his salary to Dhs15,000, according to WhatsApp messages exchanged between them, and then warned him of terminating his service with a notice period of three months.

The company’s lawyer also indicated that the employee had an amount of Dhs24,000 for the company, a laptop and a private key for his office, which he did not return, indicating that the appellant had Dhs12,000 for end-of-service dues and had used up his vacations and was not entitled to compensation for them.

The lawyer demanded that the case be dismissed and that the appellant be obligated to pay the fees and expenses of the case and lawyer’s fees.
